TERMS & CONDITIONS
PAYMENTS & DEPOSITS
Fli-Afrika reserves the right to cancel any reservation for which the deposit/balance payment has not been paid on the due date, in which event the deposit will be forfeited. Fli-Afrika reserves the right to withhold all travel documentation and event tickets until full payment has been received.
PRICE
The tour prices quoted are valid for the dates of the tour. Fli-Afrika reserves the right to adjust the tour price at any time due to currency fluctuations, airfare increases or any other unforeseen circumstances. Tour prices are based on the total package and no breakdown of costs will be provided.
PRICE EXCLUSIONS
Prices quoted do not include match tickets, costs of obtaining visas and passports, telephone calls, laundry, mini-bar services, entertainment arrangements, meals and beverages not shown in the itinerary, and any other items of a personal nature.
CURRENCY
The package prices are quoted in South African Rand (ZAR).
The match ticket prices are quoted in United States Dollar (USD) and are payable in ZAR according to the Rate of Exchange on the date of invoice as per Bidvest Bank.
PAYMENT
Fli-Afrika Travel will accept payment by electronic transfer. Payment must cover all bank charges, including sending and receiving bank charges.
CANCELLATION AND REDUCTION TABLE
No cancellations are permitted. All deposits and payments are non-refundable
ROOMING LISTS
Full passenger names and rooming lists are to be supplied by the date detailed in your proposal. No name changes are permitted after this date.
HOTELS
The hotels used for the tours, have been personally inspected by our staff and/or our agents. They have been graded and placed in our Bronze, Silver or Gold category packages based on various Fli-Afrika Travel standards and guidelines. A few grading factors are location/positioning to main World Cup venues, services offered and standard of hotel. All hotels may not be graded by TGCSA (Tourism Grading Council of South Africa).
Room configurations are detailed within the proposal. We will endeavour to assist with changes in room configurations, however, this will be based on current availability.
TRANSFERS
Transfers are based on a seat on a bus basis. Private transfers can be arranged as a special request and will incur an additional cost. Transfer times will be advised in final itineraries and every effort will be made to keep with the times given. Buses will not wait for passengers who are not at the given departure point on time, as other passengers would then be inconvenienced.
DELAYS
Fli-Afrika Travel does not hold itself responsible, nor can it be held responsible, for any delays prior to departure, or during the course of any tour, whether brought about by technical difficulties, weather conditions or any other foreseen and/or unforeseen situation. It is understood, that any expenses relating to these unscheduled extensions (e.g. hotels, meals, telephone calls etc.) will be for the passengers account.
UNUSED SERVICES / AMENDMENTS
No refund will be considered for any unused service irrespective of whether they form part of the basic inclusive price or whether they are in respect of any pre-booked optional arrangement/tour. Fli-Afrika Travel reserves the right to charge a minimal amendment fee for alterations made to bookings after the initial reservation.
ITINERARY VARIATION
While every effort is made to keep to the itinerary, Fli-Afrika Travel reserves the right to make changes for your convenience. In some cases, weather conditions can necessitate an alteration to the itinerary and this does not constitute any reason for a refund.
PASSPORT, VISA AND DOCUMENTATION REQUIREMENTS
All passengers will be personally responsible for ensuring that they are in possession of the correct documentation for their trip. The company does not accept responsibility for any consequences whatsoever arising from a passenger failing to ensure that he or she has complied with the necessary health, passport and visa requirements.
Please check with your local travel agent or the South African Embassy in your country to verify visa requirements for entry to South Africa.
LIABILITIES
Fli-Afrika Travel makes every effort to ensure that all arrangements and services connected with your tour will be carried out as specified in the most efficient and effective way possible. However, we do not, in some instances have direct control over the provision of services by suppliers and whilst they are in all cases selected with the utmost care we do not accept liability for errors and omissions of such suppliers. Fli-Afrika Travel also accepts no liability for changes, due to technical difficulties, weather conditions, strikes or communication breakdowns.
SPECIAL REQUEST
Please specify any special requests you may have at the time of making your booking or as soon as individual passengers names are given. We accept special requests on the understanding that whilst we will make every effort to comply, under no circumstances can we guarantee that they will be met at your destination.
RESPONSIBILITY CLAUSE
The Company acts as an agent only in producing and operating the tours and arrangements and on condition that it shall not be liable for any loss, damage, injury, accident, delay or any other irregularity that may be occasioned by any conveyance, or by error or default of any company or person engaged in conveying passengers carrying out the arrangements of the tour or otherwise in connection therewith.
AIRLINE RESPONSIBILITY
The passenger ticket (e-ticket) in use by the airline when issued shall constitute the sole contract between the airline and the purchaser of these tickets and/or passenger.
TRAVEL INSURANCE
Travel insurance is not included in the 2010 FIFA World Cup South Africa™ Travel Package. The individual traveller would need to secure this from his/her country of origin.
RECONFIRMATIONS
Passengers are reminded that they are responsible for reconfirmation of flights 72 hours prior to departure at any destination. Failure to do so may result in the cancellation of a flight reservation by the airline.
STAFF ACCOMMODATION
There is no discounted rate for staff accommodation over this peak period and a full package price is payable for every staff member.
FORCE MAJEURE
No party shall be liable to the other in respect of the non-performance of any of the provisions of this Agreement in the event and to the extent that such non-performance is the direct result of or has been directly caused by force majeure, which shall mean any event beyond the reasonable control of either party and which could not reasonably have been foreseen as at the date of signature of this Agreement, and shall include war, invasion, act of foreign enemy, hostilities or warlike operations (whether war be declared or not), civil war, mutiny, riot (insofar as it is uninsurable), civil commotion assuming the proportions of or amounting to a popular rising, military rising, insurrection, rebellion, revolution, military or usurped power or any act of any person acting on behalf of or in connection with any organisation with activities directed towards the overthrow by force of the government de jure or de facto or to the influencing of it by terrorism or violence, confiscation, nationalisation or requisition or destruction of or damage to property by or under the order of the government de jure or de facto or any public or local authority.
In the event that the World Cup™ is not held in South Africa, the parties shall be entitled to be restored to the same position as they were prior to the conclusion of this Agreement, and in this regard, Fli-Afrika shall refund all payments received from the client after set-off or deduction of administrative expenditure.
GOVERNING LAW
This agreement shall be governed by the laws of South Africa and the parties submit to the non-exclusive jurisdiction of the South African Courts. |
